1. Agreement to Terms

By accessing or using RankSurf ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use this Service. By using the Service, you represent and warrant that you meet these requirements.

3. Service Description

RankSurf is an AI-powered content generation platform that creates SEO-optimized articles. The Service may publish content to third-party platforms (WordPress, Notion, webhooks) on your behalf.

4. User Responsibilities

  • You must provide accurate account information and maintain its security.
  • You are responsible for all content uploaded, including assets, instructions, and materials.
  • You must have the rights to use any materials you upload to the Service.
  • You are responsible for reviewing and approving content before publication.

5. Acceptable Use

You must not:

  • Generate illegal, defamatory, fraudulent, misleading, or infringing content.
  • Use the Service to produce spam, malware, or content for deceptive purposes.
  • Upload materials containing malware, viruses, or harmful code.
  • Attempt to reverse engineer, copy, or replicate the Service.
  • Resell, sublicense, or provide access to the Service to third parties without authorization.
  • Violate any applicable laws or third-party rights.

6. Intellectual Property

The Service, including its software, design, features, and documentation, is owned by RankSurf and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

7. Content Ownership

You retain ownership of content generated through the Service. You grant us a limited license to process your materials solely to provide the Service. We do not claim ownership of your uploaded assets or generated content.

8. AI-Generated Content

Content is generated using artificial intelligence. You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or require editing.
  • We do not guarantee any specific search engine rankings, traffic results, or indexing outcomes.
  • You are responsible for fact-checking and reviewing all content before use.
  • Search engine algorithms change frequently and are outside our control.

9. Payment Terms

Subscription fees are billed in advance on a monthly basis. Subscriptions automatically renew unless cancelled. Cancellation takes effect at the end of the current billing period; no pro-rated refunds are provided. Lifetime deals are non-refundable after 14 days. We reserve the right to change pricing with 30 days notice. Failed payments may result in suspension of the Service.

10. Third-Party Integrations

The Service integrates with third-party platforms (WordPress, Notion, IndexNow). We are not responsible for the availability, performance, or policies of these third-party services. Your use of integrations is subject to their respective terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless RankSurf and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) content you upload, generate, or publish; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property or privacy rights; or (e) any claim that your content caused damage to a third party.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKSURF AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Termination

We may suspend or terminate your account for violation of these Terms or for any reason with notice. You may cancel your subscription at any time. Upon termination, your right to use the Service ceases immediately.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of Hungary. Any disputes shall be resolved in the courts of Hungary.
