Terms of Service

Effective Date: April 13, 2026

Welcome to RankSurf. These Terms of Service ("Terms") govern your access to and use of the RankSurf platform, website, and related services (collectively, the "Service") operated by RankSurf ("we," "us," or "our").

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Definitions

  • "Service" means the RankSurf web application, APIs, background processing systems, and all related services.
  • "User," "you," or "your" means any individual or entity that creates an account or uses the Service.
  • "Project" means a monitored brand configuration including a domain, brand name, competitors, and associated prompts.
  • "Prompt" means a search query submitted to AI engines for brand visibility monitoring.
  • "Scan" or "Run" means the execution of Prompts across AI engines to collect and analyze responses.
  • "Fix" means an actionable recommendation generated by the Service to improve AI visibility.
  • "Report" means a shareable snapshot of project data, scores, and recommendations.
  • "AI Engines" means the third-party AI search services currently including ChatGPT (OpenAI), Gemini (Google), and Perplexity.
  • "Content" means any data, text, prompts, brand information, or other materials you submit to the Service.
  • "Subscription" means a paid or trial plan providing access to Service features.

2. Eligibility

The Service is designed for business use. By using the Service, you represent that:

  • You are at least 16 years of age.
  • You have the legal authority to enter into these Terms.
  • If you are using the Service on behalf of an organization, you have authority to bind that organization to these Terms.

3. Account Registration

To use the Service, you must create an account using Google OAuth or a passwordless magic link sent to your email address. You agree to:

  • Provide accurate and complete information during registration.
  • Maintain the security of your account credentials and sessions.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

We do not store passwords. Authentication is handled via Google OAuth or email-based magic links through our authentication provider (Supabase).

4. Service Description

RankSurf is an AI visibility monitoring platform that:

  • Tracks brand mentions across ChatGPT, Perplexity, and Gemini by submitting your Prompts to these AI engines via their official APIs.
  • Analyzes AI responses to detect brand mentions, competitor mentions, citation URLs, and factual accuracy issues.
  • Generates Improvements — actionable, page-level recommendations to improve your brand's AI visibility, produced via automated rule analysis and AI-assisted synthesis.
  • Produces Reports — shareable, password-protected snapshots of your project's visibility data (available on Growth plans and above).
  • Audits your site — crawls pages on your domain to assess technical factors affecting AI visibility (structured data, content quality, rendering, authority).

The Service uses official AI provider APIs. We do not scrape or use unofficial access methods.

5. Free Trial

We offer a 3-day free trial on all paid plans. During the trial:

  • You have access to all features of your selected plan.
  • You will not be charged during the 3-day trial period.
  • If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.
  • You may cancel at any time during the trial without being charged.

6. Subscription Plans and Billing

6.1 Plans

We offer the following subscription tiers: Starter, Growth, Pro, and Agency. Each plan includes specific limits on the number of projects and prompts available. Certain features, such as CSV/PDF export and shareable reports, are available only on Growth plans and above. Current plan details and pricing are available on our pricing page.

6.2 Billing

All payments are processed by Polar, our Merchant of Record. Polar handles all payment processing, tax collection, invoicing, and compliance. We do not store or have access to your payment card information.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless canceled before the renewal date. You authorize recurring charges to the payment method on file.

6.4 Price Changes

We may change subscription prices with at least 30 days' written notice (via email). Price changes take effect at the start of your next billing period following the notice period. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

6.5 Taxes

Polar, as Merchant of Record, collects and remits all applicable taxes (VAT, GST, sales tax) on our behalf. The prices displayed may or may not include tax depending on your jurisdiction.

6.6 Usage Limits

Each plan enforces limits on the number of Projects and active Prompts. Prompt limits are counted across all of your Projects. Exceeding these limits requires upgrading to a higher-tier plan. We will notify you when you approach your plan limits.

7. Cancellation and Refunds

7.1 Cancellation

You may cancel your subscription at any time through the Polar billing portal accessible from your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You retain full access to all features until the period expires.
  • After expiration, access to the dashboard and scanning capabilities is suspended. Your data is retained but you will need an active subscription to access it.

7.2 Refunds

Subscription fees are generally non-refundable. If you believe you are entitled to a refund due to a billing error or service issue, please contact us at legal@ranksurf.com. Refund requests are evaluated on a case-by-case basis.

8. User Content and Data

8.1 Ownership

You retain all rights to the Content you submit to the Service, including your brand name, domain, competitors, brand facts, and Prompts.

8.2 License to RankSurf

By submitting Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your Content solely for the purpose of providing and improving the Service. This includes:

  • Submitting your Prompts to AI engines for monitoring.
  • Sending your domain, brand name, and competitor information to AI providers during fix generation and analysis.
  • Crawling pages on your specified domain for site audits.

8.3 Your Responsibilities

You represent and warrant that:

  • You have the right to submit all Content you provide to the Service.
  • You have a legitimate business interest in the brand names and domains you monitor.
  • Your Content does not infringe the intellectual property or other rights of any third party.
  • Your Prompts do not contain illegal, harmful, or malicious content.

9. AI Engine Disclaimers

9.1 Third-Party AI Responses

The Service relies on third-party AI engines (ChatGPT, Perplexity, Gemini) to generate responses to your Prompts. We do not control the output of these AI models. AI responses:

  • May vary each time the same Prompt is submitted.
  • May change as AI providers update their models.
  • May contain inaccuracies, omissions, or biases.
  • Are not guaranteed to be reproducible or consistent.

9.2 No Guarantee of Visibility

The Service monitors and analyzes your brand's presence in AI responses. We do not guarantee:

  • That your brand will be mentioned or cited by any AI engine.
  • That implementing our Improvements will result in improved AI visibility.
  • That visibility scores will improve over time.
  • Any specific business outcome from using the Service.

AI models are controlled by their respective providers, and their behavior is outside our control.

9.3 Accuracy Detection

The Service detects potential factual inaccuracies in AI responses about your brand by comparing them against the brand facts you provide. This detection is automated and may not catch all inaccuracies, nor may all flagged issues be actual errors.

10. Improvement Recommendations

Improvements generated by the Service are suggestions only. They are produced through a combination of automated rule analysis and AI-assisted synthesis. You acknowledge that:

  • Improvements are recommendations, not guaranteed solutions.
  • You are solely responsible for evaluating, prioritizing, and implementing any Improvements.
  • We are not liable for any business impact — positive or negative — resulting from following or ignoring Improvement recommendations.
  • Improvement quality depends on the accuracy of the data you provide (brand facts, domain, competitors).

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Monitor domains or brands you do not own or have authorization to represent.
  • Submit Prompts designed to manipulate, abuse, or exploit AI engines.
  • Attempt to scrape, resell, or redistribute data obtained through the Service.
  • Share your account credentials with unauthorized third parties.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated tools to access the Service beyond the APIs and interfaces we provide.
  • Interfere with or disrupt the Service's infrastructure or other users' access.
  • Submit Content that is illegal, defamatory, obscene, or infringes third-party rights.

We reserve the right to suspend or terminate accounts that violate these terms.

12. Shared Reports

The Service allows you to generate shareable Reports with optional password protection (available on Growth plans and above). You acknowledge that:

  • You are responsible for who you share Report links and passwords with.
  • Shared Reports contain a snapshot of your project data at the time of generation.
  • We are not liable for any consequences of sharing your data via Reports.
  • You may revoke shared Report access at any time from your settings.

13. Project Claims and Transfers

The Service supports one-time claim links that allow ownership transfer of a Project. By using this feature:

  • Claim links are generated by authorized administrators and may be revoked at any time before redemption.
  • Each claim link can only be used once.
  • Claiming a Project transfers full ownership, including all associated data.
  • The transfer is irreversible once completed.

14. Intellectual Property

14.1 Our Property

The Service, including its design, code, algorithms, user interface, documentation, and trademarks, is owned by RankSurf and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

14.2 Your Property

You retain ownership of all Content you submit. These Terms do not transfer any of your intellectual property rights to us.

14.3 AI Engine Outputs

Responses generated by AI engines are subject to the terms and conditions of their respective providers (OpenAI, Google, Perplexity). We make no claim of ownership over AI-generated content displayed in the Service.

14.4 Aggregated Data

We may use aggregated, anonymized data derived from Service usage for product improvement, research, and benchmarking. This data cannot be used to identify any individual user or project.

15. Third-Party Services

The Service integrates with third-party services to provide its functionality. These include, but are not limited to:

Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the availability, accuracy, or actions of third-party services.

16. Service Availability

16.1 "As Is" Basis

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Service.

16.2 No SLA

We do not currently offer a service level agreement (SLA). We make commercially reasonable efforts to maintain high availability but do not guarantee specific uptime percentages.

16.3 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that reduce functionality, we will provide at least 30 days' notice via email.

16.4 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects Service availability. We will endeavor to notify users in advance of planned maintenance.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI ENGINE OUTPUTS.
  • WARRANTIES THAT FIXES OR RECOMMENDATIONS WILL ACHIEVE ANY SPECIFIC RESULT.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
  • WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) AI ENGINE OUTPUTS OR THEIR ACCURACY; (B) YOUR RELIANCE ON FIX RECOMMENDATIONS; (C) THIRD-PARTY SERVICE OUTAGES OR FAILURES; (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT DUE TO YOUR FAILURE TO MAINTAIN SECURITY; (E) BUSINESS DECISIONS MADE BASED ON DATA PROVIDED BY THE SERVICE.

19. Indemnification

You agree to indemnify, defend, and hold harmless RankSurf and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you submit to the Service.
  • Your use or distribution of shared Reports.

20. Termination

20.1 Termination by You

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Upon termination, your data will be deleted in accordance with our Privacy Policy.

20.2 Termination by Us

We may suspend or terminate your access to the Service immediately if:

  • You breach these Terms.
  • You engage in fraudulent, illegal, or abusive behavior.
  • Your account has been inactive for an extended period.
  • Required by law or regulatory action.

We will make reasonable efforts to notify you before termination unless the termination is due to an urgent security or legal concern.

20.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately.
  • We may retain your data for a reasonable period to comply with legal obligations, resolve disputes, or enforce these Terms, after which it will be deleted.
  • Provisions that by their nature should survive termination (including Sections 8, 14, 17, 18, 19, and 21) will survive.

21. Changes to These Terms

We may update these Terms from time to time. For material changes, we will:

  • Provide at least 30 days' notice via email to the address associated with your account.
  • Update the "Effective Date" at the top of this page.
  • Post the revised Terms on our website.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.

22. General Provisions

22.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles.

22.2 Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved first through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Budapest, Hungary.

22.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

22.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

22.5 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RankSurf regarding the Service.

22.6 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
